The Appellate Division on Monday, for the third time, extended the deadline for demolishing BGMEA’s illegal building on Hatirjeel Lake in the capital.A four-judge bench, chaired by the Chief Justice Syed Mahmud Hossain passed the order, accepting the undertaking filed by the BGMEA that it would not seek further time to demolish the illegal structure. The BGMEA in its undertaking also said that it would bear the liability for the failure to demolish its illegal structure on the Hatirjheel Lake within the extended deadline. The BGMEA did not demolish its illegal building in 90 days from April 3, 2011 as directed by the High Court Division. In 2016, the Appellate Division directed RAJUK to demolish BGMEA Building and realise the costs of demolition from BGMEA if it failed to do it within 90 days.Since March 12, 2017, the Appellate Division extended the deadline for the demolition twice, once for six months and again for seven months.Such extension of deadlines by the Appellate Division after rejection of review petition was unprecedented, said lawyers. The BGMEA already missed both the extended deadlines set by the Appellate Division.
